Sephora “Survey-To-Win” Sweepstakes Official Rules

No Purchase Necessary to Enter or Win. The SEPHORA “Survey-to-Win” (the “Sweepstakes”) is a series of weekly sweepstakes. The Sweepstakes begins at 12:00:01 a.m. Pacific Time (“PT”) on May 19, 2008 and ends on Jan 4, 2009 at 11:59:59 p.m. PT (the “Sweepstakes Period”). During the Sweepstakes Period, SEPHORA will conduct 10 weekly sweepstakes (“Weekly Sweepstakes”) drawn on a monthly basis (“Monthly Drawings”). Each Weekly Sweepstakes will begin at 12:00:01 a.m. PT on the Monday of each week and will end at 11:59:59 p.m. PT on the following Sunday (“Drawing Deadline”). Sweepstakes is sponsored by Sephora USA, Inc., (“Sponsor”) 525 Market Street, 32nd Floor, San Francisco, CA 94105 and administered by Medallia, Inc., 1010 El Camino Real, Suite 340, Menlo Park, CA 94025 (collectively, “Sweepstakes Entities”).

ELIGIBILITY.

Sweepstakes is open only to current legal residents of the continental U.S., Alaska and Hawaii, and Canada (excluding Quebec) who are over the age of 16 at the time of entry. Employees, shareholders, officers, directors, agents, representatives of Sweepstakes Entities and their immediate family members and those living in their household, and each person or entity connected with the production, administration or judging of the Sweepstakes, and each parent company, affiliate, subsidiary, agent and representative of any aforementioned entity are not eligible.

HOW DO I ENTER?

You may enter one of three ways: by completing an online survey, or by entering online or by mail.

ONLINE SURVEY ENTRIES

During the Sweepstakes Period, you may visit the webpage located at http://survey.medallia.com/sephora and complete an online survey. Upon completion of the survey you will be given the option to enter the Weekly Sweepstakes for a chance to win a prize (“Prize”). Complete your online entry form by providing all required information and submit your entry according to the directions on the screen. Entrants must provide their full name, address, daytime telephone number, and a valid e-mail address.

ONLINE ENTRY (Without Survey)

During the Sweepstakes Period, you may also enter online by visiting the webpage located at http://survey.medallia.com/sephorasws?unit=111. Follow the Sweepstakes link, complete your online entry form by providing all required information and submit your entry according to the directions on the screen.

For all online entries (survey and non-survey):

Your Weekly Sweepstakes entry will be determined as received by the Drawing Deadline for that week, according to Sweepstakes administrator’s time clock. Entries received after the Drawing Deadline but before the end of the Sweepstakes will roll over to the following week. No hand or e-mail deliveries of entries will be accepted. Sweepstakes entities are not responsible for late, incomplete, void, corrupted, garbled, misdirected, or otherwise unintelligible entries or for any problems, bugs or malfunctions you may encounter when submitting your entry. Incomplete, garbled, corrupted or otherwise illegible entries are void and will not be accepted. Sweepstakes Entities reserve the right to disqualify false entries or entries suspected of being false. All entries submitted become the sole property of Sweepstakes Entities and will not be acknowledged or returned. Only one entry per natural person per email address for each Weekly Sweepstakes is allowed. In the event of a dispute as to the identity of a winner, the winner will be deemed to be the person in whose name the e-mail account governing the e-mail address was opened.

MAIL IN ENTRIES

Print your full name, address (including zip code), daytime phone number (including area code), and email address on a 3x5 card with proper postage affixed to an envelope or pre-paid shipping, and mail to Sephora Weekly Sweepstakes, 1010 El Camino Real, Suite 340, Menlo Park, CA, 94025. The card must contain all requested information or the entry may be disqualified. Mail-in entries must be postmarked by no later than the last day of a Weekly Sweepstakes period and received no later than five days (5) days after the deadline for a Weekly Sweepstakes period (“Drawing Deadline”). Any entries not received by the Drawing Deadline but before the end of the Sweepstakes will automatically be entered to win in the following week’s drawing. For the final Weekly Sweepstakes period, entries must be postmarked no later than the last day of the Weekly Sweepstakes period as listed above and received no later than 5 days after the Weekly Sweepstakes Period. Entrants must provide all information requested to be eligible to win. Incomplete, unreadable, postage-due or unintelligible entries, in the sole discretion of Sweepstakes Entities, will be disqualified. Sweepstakes Entities will not verify receipt of entries. Only one mail-in entry per natural person per Weekly Sweepstakes. allowed. Entrants submitting multiple mail-in entry forms will be disqualified. All entries submitted become the sole property of Sweepstakes Entities and will not be acknowledged or returned.

SELECTION AND NOTIFICATION OF CHOSEN ENTRANTS.

Each qualified entry will be entered into the weekly random drawing for a Grand Prize. Drawings will be held on a monthly basis, during which four winners – one from each Weekly Sweepstakes – will be selected. The drawings will occur on or about the following dates:

The schedule represents roughly the 7th day after the close of the previous Monthly Drawing period (“Drawing Date”). On each of the 3 Drawing Dates, one entrant per weekly drawing — or four entrants total — will be selected at random by a representative of Sweepstakes Entities from among all eligible entries received by the respective deadlines, for the prize. All selected entrants will be required to respond (as directed) to the phone and/or e-mail notification within 72 hours of attempted notification. The failure to respond timely to the notification may result in forfeiture of the prize and, in such case, Sweepstakes Entities may randomly select an alternate chosen entrant from among the remaining eligible entries. Each selected entrant may also be sent an affidavit of eligibility / liability / publicity release (“Release”). Except where prohibited by law, selected entrants must allow Sweepstakes Entities to use their name, picture, and winning story for marketing purposes. Selected entrants may also be required to provide name, U.S. Social Security Number (for tax form purposes), birth date, current address and phone number. Unless restricted by law, each selected entrant will be required to complete and return the Release within the time period specified therein. An alternate selected entrant may be randomly selected from among the remaining eligible entries if a selected entrant: (i) cannot be reached; (ii) fails to obtain all signatures on the Release and to return the documents in a timely manner as required pursuant to these Official Rules; or (iii) cannot accept or receive the prize for any reason. Selected entrants will receive the awarded prize by mail within thirty (30) days of the Weekly Sweepstakes end date. Selected Entrants who are minors shall be subject to prior approval of parent or legal guardian prior to awarding any prize.

PRIZES.

For each of the 3 monthly drawings, One (1) randomly selected entrant (“Chosen Entrant”) from each Weekly Sweepstakes will receive a Grand Prize of a SEPHORA Gift Card with worth Two Hundred Fifty U.S. Dollars (US $250.00) (4 Chosen Entrants total). All taxes are the sole responsibility of the Grand Prize selected entrant. Approximate retail value (“ARV”) of Grand Prize is two hundred fifty U.S. dollars (US $250.00). Total number of prizes: 10. Total value of all prizes for: $2,500 for the total Sweepstakes Period, and $1000.00 per drawing period. All prizes will be awarded. A Chosen Entrant is not barred from winning a prize in any of the weeks, based upon winning in a prior week. In the event that Chosen Entrant is a Canadian resident, the Canadian Chosen Entrant will be required to answer a bona fide skill question in order to receive the prize.

The odds of winning depend on the total number of eligible entries received.

CONDITIONS.

Sweepstakes is subject to these Official Rules. By participating, entrants agree to be bound by these complete Official Rules, and the terms of service, which can be found at http://www.medallia.com/sweepstakes/. All decisions of Sweepstakes Entities are final and binding and entrants agree to waive any right to claim ambiguity in the Sweepstakes or these Official Rules, except where prohibited by law. By accepting a prize, winner agrees to release Sweepstakes Entities, their attorneys, affiliates, together with the respective directors, employees, officers, licensees, licensors and agents of each, including without limitation, their respective advertising and promotion entities and any person or entity associated with the production, judging, or administration of the Sweepstakes, (collectively, the Releasees) from any and all liability, loss or damage arising from or in connection with awarding, receipt and/or use or misuse of prize or participation in any prize-related activities. Sweepstakes Entities reserve the right to use the Sweepstakes for publicity purposes in any media, and to use the name, likeness, and hometown name and/or prize information of selected entrants as part of that publicity, without any compensation or prior review unless prohibited by law. Taxes, if any, are the sole responsibility of selected entrants, and selected entrants who are U.S. residents may be issued an IRS Form 1099 for the ARV of any awarded prize. This Sweepstakes is void outside the continental US, Alaska, Hawaii, and Canada (excluding Quebec), and where prohibited or restricted by law, and subject to applicable federal, state provincial and local laws. Sweepstakes Entities reserve the right to disqualify any entrant it finds to be tampering with the entry process or the operation of the Sweepstakes or violating these Official Rules. The Releasees shall not be liable for: (i) late, lost, delayed, stolen, misdirected, postage-due, incomplete unreadable, inaccurate, garbled or unintelligible entries, communications or affidavits, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses or damages of any kind caused by the prize or resulting from acceptance, possession or use of a prize, or from participation in the Sweepstakes; or (v) any printing, typographical, administrative or technological errors in any materials associated with the Sweepstakes. Sponsors disclaim any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Sweepstakes, and reserve the right, in their sole discretion, to cancel, modify or suspend the Sweepstakes should a virus, bug, computer problem, unauthorized intervention or other causes beyond Sponsors’ control, corrupt the administration, security or proper play of the Sweepstakes. Sponsors may prohibit an entrant from participating in the Sweepstakes or winning prize if, in its sole discretion, it determines such entrant is attempting to undermine the legitimate operation of the Sweepstakes in any way by cheating, hacking, deception, or any other unfair playing practices of intending to annoy, abuse, threaten or harass any other players or Sponsors representatives. Use of any automated system to participate is strictly prohibited and will result in disqualification. Sponsors may disqualify at its sole discretion any entries it believes are created by an automated system. Sponsors may disqualify at its sole discretion any entries it believes exceed the weekly minimum. Sponsors shall destroy all mail-in entries after 90 days. Disputes regarding these Official Rules and/or this Sweepstakes will be governed by the internal laws of the State of California. Any and all legal actions or claims arising in connection with this Sweepstakes must be brought in a court of competent jurisdiction within the United States. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OR FAIR PLAY OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL, IF DISCOVERED, RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE SWEEPSTAKES. SHOULD SUCH AN ATTEMPT BE MADE, SWEEPSTAKES ENTITIES RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

PRIVACY.

All personal information collected by Sponsors will be used for administration of the Sweepstakes. Non-personal information collected through the survey process will be separated from personally identifiable information, aggregated, stored, and may be disseminated in aggregate form (without personal information) to third parties for research purposes. In addition, entrants may receive email correspondence from, or on behalf of SEPHORA, subject to SEPHORA’s privacy policy.
